EHS & Sustainability Landscape in China

A facility in Shanghai may face a different set of EHS obligations from a similar facility operating in Guangdong or another province. While national legislation provides the foundation, provincial and municipal authorities can introduce additional or stricter requirements based on local conditions and regulatory priorities.

This creates a two-level compliance challenge. Businesses need to understand both the national requirements that apply across China and the provincial or local rules that apply to a specific site.

The national framework covers areas such as environmental protection, workplace and production safety, occupational health, and labour-related obligations. Key authorities include:

  • Ministry of Ecology and Environment (MEE), responsible for environmental protection, pollutant emissions, environmental impact assessment, and related monitoring and reporting requirements.

  • Ministry of Emergency Management (MEM), which oversees production and workplace safety, including accident prevention and safety management requirements.

  • Ministry of Human Resources and Social Security, which is responsible for labour-related regulatory matters, including requirements relevant to employment and workplace welfare.

  • Provincial and municipal governments, which may introduce additional measures or stricter requirements on top of national legislation. These can vary according to location and may affect environmental, safety, and other operational obligations.

For organisations with multiple sites, this means one national checklist may not be enough. The requirements applicable to one facility may differ from those affecting another site in a different province or municipality.

The China EHS Legal Register helps bring the national regulatory baseline together with relevant location-specific requirements, giving organisations a clearer view of the obligations that apply to their operations. It provides a practical reference for monitoring regulatory changes at both levels and managing compliance across different sites.
